1. SCOPE OF THESE TERMS

1.1 These Ferry Ticket Terms and Conditions (“Ferry Terms”) apply to all ferry tickets booked or purchased through the Ticket counter, Group Reservation or any other official booking channel operated by Langkawi Ferry Line Ventures Sdn. Bhd. (“LFLV SDN BHD”).

1.2 These Ferry Terms shall be read together with the LFLV SDN BHD group booking Terms and Conditions.

1.3 These Ferry Terms govern matters specifically relating to the booking, issuance and use of ferry tickets booked through Langkawi Ferry Line Ventures Sdn Bhd.

1.4 In the event of any inconsistency concerning a matter specifically relating to ferry tickets, these Ferry Terms shall prevail to the extent of such inconsistency.

2. FERRY TICKET BOOKING

2.1 All ferry ticket Booking are subject to seat availability at the time the Booking is processed.

2.2 Before completing a Booking, the Customer shall ensure that all travel details are correct, including:

(a) Departure port;

(b) Destination;

(c) Travel date;

(d) Departure time;

(e) Number and category of Passengers; and

(f)  Passenger information.

2.3 A Booking shall only be deemed confirmed once full payment has been successfully received and we have issued a Booking Confirmation.

2.4 The Customer shall review the Booking Confirmation immediately upon receipt and promptly notify us of any apparent error.

3. PASSENGER CATEGORIES AND NON-MYKAD HOLDER TICKETS

3.1 The Customer is responsible for selecting the correct Passenger category and ticket type when making a Booking.

3.3 A non-Malaysian Passenger who uses a ticket reserved for MyKad holders may be required to:

(a) pay the applicable fare difference;

(b) pay any applicable administrative charges; and

(c) purchase a valid replacement ticket before being permitted to board the ferry.

3.4 Proof of age, nationality, identity or eligibility may be required for the purpose of verifying the selected ticket category.

4. PASSENGER INFORMATION AND TRAVEL DOCUMENTS

4.1 The Customer shall provide complete and accurate Passenger information as required during the Booking process.

4.2 Passenger information shall correspond with a valid identification or travel document.

4.3 Passengers are responsible for obtaining, carrying and presenting all documents required for travel, including MyKad, passports, visas, permits or any other documents required by the relevant authorities.

5. TICKET VALIDITY AND USE

5.1 A ferry ticket is valid only for:

(a) The Passenger named on the ticket (For grouping must show passengers list);

(b) The travel date stated on the ticket;

(c) The departure time stated on the ticket; and

(d) The route stated on the ticket.

5.2 A ticket is non-transferable unless a change to Passenger information is permitted and approved in accordance with these Ferry Terms.

5.3 Tickets shall not be resold for commercial purposes, duplicated, altered or used unlawfully or fraudulently.

5.4 We reserve the right to cancel or refuse the use of any ticket reasonably suspected of having been unlawfully obtained, resold, duplicated or otherwise improperly used.

5.5 Expired and unused tickets are not eligible for a refund.

5.6 The Customer is responsible for ensuring that the Booking Confirmation or QR code is accessible when required.

6. SCHEDULES AND OPERATIONAL CHANGES

6.1 Departure and arrival times displayed are based on the schedules available at the time the Booking is made.

6.2 Travel times may change due to weather or sea conditions, safety requirements, port operations, technical issues, instructions from relevant authorities or other operational requirements.

6.3 The Ferry Operator may, where necessary:

(a) Delay a departure;

(b) Reschedule a journey;

(c) Cancel a journey;

(d) Substitute a vessel;

(e) Alter a route; or

(f) Omit a scheduled stop.

6.4 Customers shall allow sufficient time between their ferry journey and any flight, connecting transport, accommodation check-in or other travel arrangements.

7. CANCELLATIONS AND REFUNDS

7.1 Unless otherwise stated, all confirmed ferry tickets are non-cancellable and non-refundable once payment has been successfully completed.

7.2 A change of travel plans, change of mind, missed departure or failure to comply with boarding requirements shall not entitle the Customer to a refund.

7.3 An unused ticket shall not automatically qualify for a refund.

7.4 Where any journey under a return ticket has been used, the remaining unused journey shall not be eligible for a refund unless expressly approved under the applicable terms.

7.6 Where a ferry service is cancelled, any available alternative travel arrangement, rescheduling or refund shall be determined based on the operational circumstances and arrangements applicable to the affected journey.

8. CHECK-IN AND REPORTING TIME

8.1 Passengers shall arrive at the designated ferry terminal and complete the check-in process within the time specified in the E-Ticket, Booking Confirmation or applicable travel instructions.

8.2 Unless otherwise stated, Passengers are advised to arrive and report at the ferry terminal at least sixty (60) minutes before the scheduled departure time.

8.3 A passenger who fails to complete the check-in process within the specified time may be refused boarding without any refund or compensation.

8.4 Passengers shall present the required ticket, QR code and identification documents during check-in.

9. BOARDING AND RIGHT TO REFUSE CARRIAGE

9.1 Passengers shall be present at the designated boarding area and comply with all applicable instructions and announcements.

9.2 A Passenger may be refused carriage where the Passenger:

(a) breaches any applicable law;

(b) breaches these Ferry Terms;

(c) poses a safety or security risk;

(d) fails to present valid travel or identification documents;

(e) uses an invalid or previously used ticket;

(f) has obtained a ticket unlawfully or fraudulently; or

(g) fails to comply with any lawful safety instruction.

9.3 Where carriage is refused due to an act, omission or failure of the Passenger, the Passenger shall not be entitled to a refund or compensation.

10. NO SHOW AND MISSED DEPARTURE

10.1 A passenger who fails to check in or present themselves for boarding within the required time shall be treated as a No Show.

10.2 A Passenger who misses a journey due to lateness, an error in travel planning, failure to present the required documents or any other circumstance attributable to the Passenger shall not be entitled to a refund, replacement ticket or free rescheduling.

10.3 A passenger who wishes to travel at another time shall make a new Booking, subject to seat availability.

11. BAGGAGE AND PERSONAL BELONGINGS

11.1 Passengers may only carry baggage and personal belongings that comply with the applicable limits and requirements of the relevant ferry service.

11.2 Checked baggage shall only be released to the holder of the corresponding baggage claim tag, where a baggage tagging system is used.

11.3 Passengers are responsible for the care and safekeeping of their baggage and personal belongings.

11.4 We shall not be responsible for any loss, theft, misplacement, damage or destruction of baggage or personal belongings occurring during handling or carriage.

12. PROHIBITED ITEMS

12.1 Passengers are prohibited from carrying any dangerous, unlawful or prohibited items, including but not limited to:

(a) firearms and ammunition;

(b) explosives and fireworks;

(c) flammable liquids or gases;

(d) combustible materials;

(e) corrosive substances;

(f) toxic or poisonous substances;

(g) radioactive materials;

(h) infectious substances;

(i) prohibited drugs;

(j) hazardous chemicals;

(k) mercury;

(l) magnetised materials that may pose a safety risk;

(m) foul-smelling or offensive items; and

(n) any item prohibited under the laws of Malaysia.

12.2 The Ferry Operator or any relevant authority may refuse to carry any item considered unsafe or prohibited.

13. ANIMALS AND PETS

13.1 Animals and pets are not permitted on board unless prior approval has been obtained from the Ferry Operator and any relevant authority.

13.2 Any approval shall be subject to the applicable safety, health and operational requirements.

 

14. CARGO AND COMMERCIAL GOODS

14.1 A Passenger ticket is valid only for Passenger travel and the carriage of permitted personal belongings.

14.2 Cargo, merchandise or commercial goods shall not be carried using a Passenger ticket.

14.3 The Ferry Operator reserves the right to refuse any item reasonably suspected of being cargo or commercial goods.

15. BICYCLES

15.1 Standard bicycles are not permitted on passenger ferry services unless otherwise stated by the Ferry Operator.

15.2 A foldable bicycle may be considered for carriage where it:

(a) is properly folded or packed;

(b) does not exceed 40 cm × 27 cm × 74 cm in dimensions; and

(c) does not exceed 25 kilograms in weight.

15.3 Acceptance of a foldable bicycle is subject to available space and the approval of the Ferry Operator.

16. CHILDREN, INFANTS AND PASSENGERS REQUIRING ASSISTANCE

16.1 Children and infants shall comply with the applicable ticket and travel requirements for the selected ferry service.

16.2 A child or infant shall be accompanied by a responsible adult where required.

16.3 Any special assistance is subject to operational capability and is not guaranteed unless expressly confirmed.

17. IMMIGRATION, CUSTOMS AND REGULATORY REQUIREMENTS

17.1 Passengers are responsible for complying with all applicable laws and all immigration, customs, port, maritime and regulatory requirements.

17.2 No refund or compensation shall be payable solely because a Passenger:

(a) is refused boarding;

(b) is refused entry;

(c) is detained;

(d) is repatriated or deported; or

(e) is prevented from travelling by a relevant authority,

where such circumstances arise from invalid or insufficient documents, possession of prohibited items, failure to comply with applicable law or a lawful decision of the relevant authority.

17.3 Langkawi Ferry Line Ventures Sdn Bhd has no authority to alter, override or waive any decision made by a relevant authority.

18. OPERATIONAL DISRUPTIONS AND CIRCUMSTANCES

18.1 We shall not be responsible for any delay, cancellation, disruption or failure of service arising from circumstances beyond our reasonable control, including:

(a) adverse weather or sea conditions;

(b) natural disasters;

(c) fire or flooding;

(d) epidemics or pandemics;

(e) war or civil unrest;

(f) acts of terrorism;

(g) strikes or industrial disputes;

(h) government action or directions;

(i) port closures or restrictions; or

(j) any other unforeseen circumstance affecting the operation of the ferry service.

18.2 In such circumstances, a journey may be delayed, rescheduled or cancelled subject to the operational decisions or any relevant authority.

18.3 Any available refund or other remedy shall be subject to the terms governing the relevant Booking.

19. SAFETY AND COMPLIANCE

19.1 Passengers shall comply with:

(a) all applicable laws and regulations;

(b) terminal and port requirements;

(c) security screening procedures;

(d) instructions issued by the Ferry Operator and vessel crew; and

(e) lawful directions issued by any relevant authority.

19.2 A passenger who threatens safety, disrupts operations or fails to comply with safety instructions may be refused boarding or removed from the service to the extent permitted by applicable law.

20. AMENDMENTS TO THESE FERRY TERMS

20.1 We may amend these Ferry Terms from time to time.

20.2 Unless otherwise required by applicable law or necessary for immediate safety or compliance purposes, any amendment shall not retrospectively alter the confirmed terms applicable to an existing Booking.

20.3 The latest version of these Ferry Terms published shall apply to bookings made on or after the effective date of that version.

21. GOVERNING LAW

21.1 These Ferry Terms shall be governed by and construed in accordance with the laws of Malaysia.

21.2 Sea transportation services shall also be subject to the applicable maritime laws and regulations of Malaysia in force from time to time.

21.3 Any dispute arising out of or in connection with these Ferry Terms shall be subject to the jurisdiction provisions set out in our Website Terms of Use.

22. ELECTRONIC ACCEPTANCE

By completing a ferry ticket Booking, the Customer acknowledges that the Customer has read, understood and agreed to be bound by these Ferry Terms and any other applicable terms.

A Customer making a Booking on behalf of other Passengers is responsible for ensuring that such Passengers are informed of the applicable travel conditions.
